Legislate - First Things First

I consider it a high calling to be an elected representative. Our job scope can be vague, our schedule is demanding and our responsibilities are broad and weighty. There must be a genuine love for people or at least one must enjoy being around people. We do not have a perpetual contract as elected representatives. Time is of the essence. Reforms must be made. We are policymakers. We have not been elected to judge people. Our political offices should not take the place of religious institutions.

Recently, when a Member of Parliament claimed that the east coast floods were intended to remind the people about the necessity to impose hudud, my heart cannot be more stirred. No eye has seen, no ear has heard and no human mind has conceived the plans of God for Malaysia. How can anyone say with absolute certainty that disasters (whether man-made or otherwise) are God’s wrath to punish mankind? What if it is just a case of bad stewardship? As though it is not enough when leaders use racial politics to conceal corruption, it is more appalling when God is used as an excuse to justify leaders’ inability to govern.

God created man or woman with a free mind and most importantly a free will. God allows us to make decisions and face their consequences. And if this timeless God Almighty does not see it right to force His ways down our throats, who are we then (politicians with a mandate restricted by a political term) to shove holy laws down the throats of our electorates?

2014 has been a terrible year for the nation, marked with tragedies and regressive rule such as the continued use and misuse of the Sedition Act to silence dissenting voices.

Something’s got to give in 2015. Political leaders with executive powers must start appropriating the budget for the right projects. People must start seeing that BR1M just isn’t good enough. Such funds should be used instead for flood mitigation projects, feeding the poor and fighting crime.

They say insanity is doing the same thing over and over again and expecting different results. Unless we do things differently in 2015, history is bound to repeat. If we don’t see improvement in the Auditor-General’s Report, if extremists continue to be given unlimited media space to propagate hatred, if the government stops feeding the street kids hoping they will just disappear, if we treat our immigration rules negligently, if top political leaders do not lead by example in fighting corruption and if the people continue to vote such leaders back to power – we have no one else to blame (not even God!) but ourselves.

Lastly, for the self-righteous politicians, there really isn’t a need to second-guess God. He’s already made it plain how to live, what to do, what God is looking for in men and women. It’s quite simple: Do what is fair and just to your neighbour, to love mercy and to walk humbly with God. Anything else is beside the point.

Peletakan Jawatan YB Sungai Burong sebagai Ketua Pembangkang


Saya telah menerima surat peletakan jawatan sebagai Ketua Pembangkang daripada Y.B. Dato’ Mohd Shamsudin Bin Lias, Ahli Dewan Negeri bagi kawasan Sungai Burong yang bertarikh 8 Disember 2014 dan saya menghormati keputusan beliau untuk meletakkan jawatan sebagai Ketua Pembangkang. Saya mengucapkan terima kasih atas perkhidmatan beliau sebagai Ketua Pembangkang sejak Jun 2013. 

Seperti yang sedia maklum, Dewan Negeri Selangor telah meluluskan pindaan kepada Peraturan-Peraturan Tetap Dewan Negeri Selangor pada 4 Disember 2014 dimana Peraturan Tetap 68 (1) telah dipinda supaya Jawatankuasa Kira-Kira Wang Awam Kerajaan (PAC) hendaklah dipengerusikan oleh Ketua Pembangkang. 

68(1) Hendaklah ada sebuah Jawatankuasa yang akan dinamakan Jawatankuasa Kira-kira Wang Kerajaan dilantik pada awal tiap-tiap penggal persidangan dan dipengerusikan oleh Ketua Pembangkang kerana memeriksa:
(a) kira-kira Kerajaan Negeri Selangor dan peruntukan wang yang dibenarkan oleh Dewan kerana menepati perbelanjaan Negeri;
(b) apa-apa kira-kira badan pentadbiran raya dan pertubuhan lain yang menguruskan wang negeri yang menguruskan wang negeri yang dibentangkan dalam Dewan;
(c) penyata Juru Audit Negara dibentangkan dalam Dewan menurut Perkara 107(2) dalam Perlembagaan Persekutuan; dan
(d) apa-apa perkara lain yang difikirkan oleh Jawatankuasa itu patut diperiksa, atau apa-apa perkara yang diserahkan oleh Dewan kepada Jawatankuasa itu.

Oleh yang demikian, saya menggesa Barisan Nasional (BN) Negeri Selangor menamakan salah seorang daripada Ahli Dewan Negeri Selangor BN sebagai Ketua Pembangkang supaya pihak pembangkang BN dapat melaksanakan tugas dan memainkan peranan mereka di dalam pentadbiran Dewan Negeri Selangor secara efektif dan berkesan demi rakyat Selangor.

Saya mengambil maklum bahawa Y.B. Dato’ Shamsuddin ada membangkitkan isu komposisi di dalam Jawatankuasa PAC yang didakwa berat sebelah dan tidak mencerminkan semangat demokrasi yang sebenar. Saya ingin menyatakan di sini bahawa Peraturan Tetap 72 (1) bagi Peraturan-Peraturan Tetap Dewan Negeri Selangor secara nyata memperuntukan bahawa komposisi ahli bagi tiap-tiap Jawatankuasa Pilihan hendaklah membayangkan kadar parti masing-masing di dalam Dewan. Peruntukan yang sama juga terdapat di dalam Peraturan-Peraturan Majlis Mesyuarat Dewan Rakyat melalui Peraturan 82 (1). Amalan yang sama digunapakai oleh parlimen di negara komanwel yang lain seperti di Australia, United Kingdom, India dan New Zealand.

It's done - Reforms cast in stone!

The Selangor State Legislative Assembly has approved 3 key proposals by the Standing Orders Committee chaired by the Speaker aimed at protecting the transparency and the accountability of its members toward voters and the people of Selangor.

Our Standing Orders have been amended to incorporate the followings:-

(1) Live broadcast - Since 2008, the proceedings of the Selangor State Legislative Assembly have been broadcasted in its entirety live on the web. This was a big step forward in improving the accessibility of the State Legislative Assembly to the people. This feature is now made mandatory by including into the Standing Orders (‘Peraturan Tetap’) of the Assembly a requirement for a live web or television broadcast of every sitting. This effectively compels the State Government of the day to set aside sufficient funds annually to enable a live broadcast.

(2) Compulsory for Public Accounts Committee to be chaired by Opposition Leader - Selangor had previously, on two separate instances for the 12th and 13th Selangor State Legislative Assembly, broke new grounds in our local legislative practice but in keeping with international practice offered the position of Chairman of the Public Accounts Committee to the Leader of the Opposition. But on both instances, the offer was turned down. We have now amended our Standing Orders to make it mandatory for the Public Accounts Committee to be chaired by the Leader of the Opposition. The role of the Opposition cannot be taken for granted as an effective check and balance in any legislative assembly and as such there should be no discretion in his appointment to chair the influential Public Accounts Committee.

(3) Government's response to Select Committees' Reports - the Assembly now has 10 active Select Committees. These Select Committees conduct enquiries on issues pertaining to the state administration and their reports are tabled, debated and approved by the House. The Standing Orders have been amended to make it compulsory for the State Government to report to the State Assembly on actions taken on the findings and recommendations of these Select Committees. The Executive must be accountable to the Legislative.

The amendments above serve to bind the present and future state governments to a system of governance that is not subject to the whims and fancies of the government of the day or even the Speaker of the day. 

We have now cast in stone the reforms that were made so that these reforms no longer remain simply as good and noble practices, but enshrined as law.

Speaker: Hati-hati tangani isu kalimah ALLAH

SHAH ALAM - Susulan isu serbuan yang dilakukan Jabatan Agama Islam Selangor (Jais) terhadap Persatuan Bible Malaysia (BSM), Speaker Dun Selangor, Hannah Yeoh meminta kerajaan negeri itu berhati-hati dalam menangani isu tersebut.

Menurutnya, isu yang melibatkan Jais dan BSM itu adalah isu sensitif dan berat.

"Kerajaan negeri mesti berhati-hati menghadapi masalah ini. Sensitiviti semua agama mesti dijaga.

"Tindakan Jais merampas Bible tanpa memaklumkan exco dan menteri besar selepas kejadian Gereja Methodist Damansara Utama bukan perkara ringan.

"Yang dirampas adalah Bible yang turut dianggap kitab suci," katanya kepada Sinar Harian Online melalui SMS, hari ini.

Jumaat lalu, Jais memberitahu agensi itu terlupa untuk memaklumkan kepada jabatan-jabatan berkaitan dalam kerajaan negeri berhubung serbuan yang menyaksikan lebih 300 salinan Bible dirampas di pejabat BSM pada Khamis.

"Jais mendakwa bahawa mereka melakukan serbuan itu kerana merasakan ia melanggar Enakmen 1988 tentang penggunaan kalimah ALLAH" ujar  Exco Hal Ehwal Islam Selangor, Sallehen Mukhyi

Dalam pada itu Hannah yang juga Adun Subang Jaya berkata, beliau menunggu respon daripada Menteri Besar Selangor berhubung pengakuan Jais itu.

"Saya tak komen isu ini lagi... tunggu menteri besar komen selepas mendapat laporan Jais memandangkan Jais sudah mengaku terlupa memaklumkan kepada kerajaan negeri.

"Saya mahukan perpaduan rakyat Selangor dijaga," katanya lagi.

Kerajaan Selangor telah memperkenalkan dan mengguna pakai garis panduan baharu dalam penggunaan peruntukan Sistem Maklumat Rekod Jalanraya Malaysia atau MARRIS bermula 2012 selepas mendapati garis panduan yang lama terbuka kepada salah guna kuasa serta ketirisan.

Sehubungan itu, kerajaan negeri telah membuat ketetapan khusus dan garis panduan yang ketat bagi memastikan penggunaan peruntukan MARRIS digunakan dengan betul, berkesan dan menepati keperluan kumpulan sasaran iaitu rakyat Selangor.

Menteri Besar, Tan Sri Abdul Khalid bin Ibrahim berkata oleh kerana garis panduan baru ini melibatkan banyak agensi dan peringkat selain turut melibatkan proses tender terbuka – telah menyebabkan kelewatan dalam pembelanjaan wang MARRIS.

“Kami mencari formula yang terbaik bagi memastikan wang tersebut dibelanja setimpal dengan kerja yang dilakukan serta memberi pulangan yang terbaik kepada rakyat Selangor.

“Kelewatan juga disebabkan Kerajaan Negeri mahu mengambil kira pandangan akar umbi yang melibatkan Ketua Komuniti, Ahli Majlis, ADUN dan Ahli Parlimen berkenaan projek-projek mendesak mengikut keutamaan mereka.

“Selain itu, proses rundingan dan khidmat nasihat serta penetapan formula terbaik untuk dipakai Jawatankuasa Pelaksana turut menyumbang kepada kelewatan dalam membelanjakan peruntukan MARRIS yang disalurkan oleh Persekutuan,” kata beliau.

Beliau juga berkata, meskipun berlaku kelewatan namun garis panduan baharu telah berjaya diguna pakai dan terdapat penjimatan ketara dari segi kos serta nilai yang perlu dibayar bagi projek-projek yang dilaksanakan dan ianya sangat penting dan bermakna kepada kerajaan negeri.

Sebagai contoh, untuk projek bawah PBT, kerajaan negeri telah berjaya menjimatkan sejumlah RM29.21 juta atau 24.5% daripada kos anggaran projek, RM1.02 juta atau 21.1% untuk projek bawah pejabat daerah dan RM62.82 juta atau 18% untuk projek bawah Kerajaan Negeri.

“Ini bermakna, secara keseluruhannya Kerajaan Negeri telah menjimatkan sejumlah RM93 juta atau 19.3% daripada anggaran jabatan dan dana ini boleh digunakan untuk projek lain yang berguna kepada rakyat,” katanya lagi.

Menteri Besar menegaskan, beliau tidak gusar dengan Laporan Audit 2012 tersebut kerana wang MARRIS yang tidak dibelanjakan tidak hangus sebaliknya akan diletakkan di dalam akaun Kumpulan Wang Amanah Penyelenggaran Jalan Negeri dan boleh digunakan apabila perlu.

Dengan penjimatan itu juga peruntukan MARRIS untuk Selangor bagi tahun 2013 masih berbaki RM149 juta selepas RM290 juta atau 66.3% telah dibelanjakan  bagi projek infrastruktur seluruh Selangor  seperti  membaiki jalan dan  cerun
“Sebagai kerajaan yang bertanggungjawab serta mengutamakan ketelusan dan pertanggungjawaban, Selangor lebih suka menggunakan dengan cermat dan berhati-hati kerana jika kita berbelanja atas sebab kita mahu menghabiskan peruntukan, kebarangkalian untuk berlaku ketirisan amat tinggi. Jika ini berlaku, akhirnya rakyat Selangor juga yang akan rugi,” tambah beliau.

Berhubung teguran Audit Negara berkenaan kelewatan membelanjakan wang MARRIS tersebut, Menteri Besar berpandangan sepatutnya Audit Negara menumpukan fokus kepada tatacara penggunaan wang yang disalurkan;  samada mengikut ketetapan dan garis panduan kewangan yang betul bukannya isu wang tersebut dibelanjakan sepenuhnya.

Menteri Besar juga berasa agak musykil dengan pendedahan Audit bahawa menurut tinjauan Audit Negara rakyat dikatakan tidak berpuashati terhadap mutu jalan raya Selangor kerana Menteri Besar berpandangan penyataan tersebut menunjukkan jabatan telah lari dari tugas dan matlamat sebenar yakni memastikan wang dibelanjakan dengan tertib dan mengikut garis panduan yang ditentukan Perbendaharaan.

Menteri Besar turut menegaskan situasi buruk jalan raya di negeri ini adalah disebabkan jalan-jalan tersebut tidak diturap dengan baik sejak 20 tahun yang lalu dan turapan secara permukaan sahaja tidak dapat menampung kerosakan teruk.

Kerajaan Selangor komited untuk memastikan infrastruktur dalam keadaan baik dan memuaskan demi keselesaan rakyat yang  selama ini memberi sumbangan besar terhadap pembangunan dan kemajuan negeri.
